Data protection policy

The Data Protection Policy (the "Policy") describes how PIERRE FREY SAS, a company incorporated under French law whose registered office is located at 47 rue des Petits Champs, 75001 Paris, France, and/or its subsidiaries, processes, as data controller, the personal data of its customers and prospects in order to provide you with the best service. This policy also deals with the protection of data of applicants for vacant positions collected via the website or by any other means (email, mail...).

PIERRE FREY SAS and/or your locally responsible PIERRE FREY entity collects, stores, processes, uses and discloses personal data about you when you use the PIERRE FREY website or when you visit our social networking pages, or when you contact our sales teams or visit one of our PIERRE FREY showrooms in your country.

 

1 - WHAT CATEGORIES OF DATA DO WE COLLECT?

PIERRE FREY collects the following categories of data, for the purposes described below:

  • Your identity and contact details (such as name, first name, address, telephone number or e-mail address, position), when you decide to communicate them, mainly to browse the website, create a customer account, order and have products delivered or participate in an event;
  • Payment information: for example, your bank account details, or the payment information you need to provide to pay for products or services you have ordered from us;
  • Demographic information such as your gender and date of birth;
  • Information you provide us to participate in a marketing survey;
  • Information relating to your orders transmitted to the sales department (type, quantity of products purchased and their prices);
  • If you use our website: information about your browser and browsing behaviour;

We collect this data directly from you (when you create an account on our website, make a purchase, or contact our advisors or sales representatives), or passively (through the use of cookies or browser tracking).
If you do not wish to submit data about yourself when it is necessary for the performance of a contract or service you are requesting, or when it is required by law, you will not be able to receive the requested product or service.

 

2 - FOR WHAT PURPOSE DO WE USE YOUR DATA?

Your data is used for the purposes described below:

If you are an existing or potential PIERRE FREY customer, we may use your personal data for the following purposes:

  • Allow you to browse our website and use your personal account online;
  • Process your orders, answer your questions, manage your possible complaints: we use your data, in particular to deliver your orders, invoice them and collect these invoices, manage returns of goods. We use your data to provide you with the information you request, or to communicate with you about your account or our relationship. In this case, the processing of your information is for the purpose of executing the contract concluded between you and PIERRE FREY;
  • For Marketing purposes: to contact you, with your consent, about our products and services, to send you invitations to events that may be of interest to you and News Letters and to submit marketing surveys; 
  • For analysis and statistical purposes: we measure the effectiveness of our online and offline campaigns or events, as it is in our legitimate interest to preserve and develop PIERRE FREY's image. For security purposes: we process your data to protect our company, our customers, our site or our applications against the risks of fraud, theft or any reprehensible act that may affect our business because it is in our legitimate interest to ensure the security of our online and offline activities;
  • Better understand your interests and how you use our products and services: we use your data to improve our website, and our products. We also use your data to tailor our marketing and sales activities to your needs and preferences, as it is in our legitimate interest to serve you better and meet your expectations;
  • Against sales of PIERRE FREY products made in violation of our general conditions and in violation of our exclusive distribution network (by analysing, in particular, the quantities or frequency of purchases made) insofar as the protection of our distribution network is in our legitimate interest;
  • Other purposes: we maintain a history of transactions and other business documents to meet legal, administrative, tax or audit requirements. 

If you are a candidate for a vacant position at PIERRE FREY we may use your personal data for the following purpose:

Properly evaluate applications for vacant positions through CVs submitted and other information relating to your career path by using internal and external recruitment specialists to determine whether we should sign an employment contract with you on the basis of our legitimate interest in hiring the most qualified people.

 

3 - WITH WHOM DO WE SHARE YOUR DATA?

We only communicate or share your data in the following cases:

  • Only authorised personnel of PIERRE FREY SAS or its subsidiaries or subsidiaries or its commercial agents and distributors whose activity justifies access to information for administrative management, invoicing and collection purposes. 5 - TRANSFER OF YOUR DATA

6 - SHELF LIFE

Your data will only be stored, in a form that allows you to be identified, for as long as is reasonably necessary for the purposes described in Article 2, or for as long as is permitted by law. The storage period of your data is determined according to the following criteria:

  • three (3) years after our last contact, if you are a prospect (i.e. if you have not made any purchases from PIERRE FREY but you are interested in the latest news from our House;
  • ten (10) years after the end of our business relationship, if you are a customer (i.e. you have purchased one of our products or services);
  • Your data will then be archived, and may be used in a dispute, action or litigation, during the applicable limitation period. In the case of legal action, the data may be stored until all legal remedies have been exhausted, and will then be deleted or archived to the extent permitted by law;
  • Your data is then destroyed or anonymized.

 

7 - YOUR RIGHTS

You can request access to the data we hold about you. In this case, we will provide you with the information required by law on the purposes of the processing, the categories of data processed, the categories of recipients, the duration of data storage, etc....

You may also obtain a copy of any information about you that we hold about you, in a compatible and structured format allowing you to exercise your right to data portability, for processing based on your consent or the performance of a contract between you and PIERRE FREY.

You may also ask us to correct, modify, or delete any incomplete, obsolete or inaccurate information. 
You may request the deletion of your data if (i) they are no longer necessary for the intended purpose, (ii) you have withdrawn your consent when the processing in question was based on that consent, (iii) you have objected to the processing (iv) the processing of the data is illegal, (v) the information must be deleted in accordance with legal obligations applicable to PIERRE FREY. PIERRE FREY will take reasonable steps to inform the other entities of the PIERRE FREY group of such deletion. You may request the limitation of processing (i) if you dispute the accuracy of your personal information, which will allow PIERRE FREY to verify this accuracy, (ii) if you wish to limit the processing of your information rather than the deletion of it despite the fact that the processing is unlawful (iii) if you wish PIERRE FREY to keep your information because you need it for the establishment, exercise or defence of your legal rights (iv) the time necessary for PIERRE FREY to examine the validity of your opposition request.
You also have the right to file a complaint with the competent supervisory authority.

Where the processing of your data is based on consent (for example, if you have agreed to receive commercial communications), you may withdraw this consent at any time, which will not affect the legitimacy of processing operations carried out before the withdrawal of your consent.

Where the processing operations we carry out are based on our legitimate interest, you may object to such processing if it transpires that your interests or fundamental freedoms prevail over our legitimate interests.

8 - PROTECTION OF YOUR PERSONAL DATA

We will ensure an adequate level of protection for your data and ensure that appropriate technical and organisational security measures (including awareness and training of personnel involved in processing operations) are in place to protect your data against accidental or unlawful destruction, accidental loss or alteration, unauthorised disclosure or access, and against all other unlawful forms of processing.

However, since the Internet is not completely secure, we cannot guarantee that your personal information stored or sent will be completely secure. We encourage you to exercise caution when using the Internet to access our website or social media.

 

9 - CHILDREN

Our website is not intended for children. We do not knowingly collect information about children without the consent of a parent or guardian, except as permitted by law.

You must be at least 16 years old to provide us with your data, and 18 years old to carry out transactions with our sales teams, in our showrooms or on our website. By entering into these transactions, you warrant that you are at least eighteen years of age and are fully capable of entering into and being legally bound by such transactions.

If we are informed, or if we learn that a minor has submitted information to us via our media or otherwise, we will delete that information.
